Attorney General backs MEC Commissioners Kunje, Mathanga; tells OPC to formally hire them

LILONGWE (MalawiTalk) –The Office of the President and Cabinet (OPC) has been disregarding  advice from the Attorney General, Dr Chikosa Silungwe regarding the appointment of two commissioners at Malawi Electoral Commission (MEC) Mrs Jean Mathanga and Miss Linda Kunje  by not writing the two their appointment letters.

According to a letter dated 28th September, 2020 addressed to the Chairperson of the Electoral Commission, Justice Dr Chifundo Kachale, the Attorney General says that the two should continue to serve as commissioners and that OPC should  formally write their letters of appointment.

Reads the letter: “I urge the Secretary to the President and Cabinet who is in copy to formally write commissioner, Kunje and Mathanga on their appointment. ”

However, the two had not received their letters of appointment.

Silungwe – Backs Mathanga, Kunje

Sulungwe adds: “While the remedy of judicial review remains available, it must not be used.”

Kunje and Mathanga were recommended by the former ruling Democratic Progressive Party (DPP).

The two were appointed last year together with other  five commissioners amidst concerns from then opposition parties of their competences and impartiality before the fresh presidential election.

They were part of the commission led by justice Dr Jane Ansah which presided over the nullified presidential elections.

The rest were given their letters of appointment except last year.
